These Terms of Service ("Terms") govern your use of this website and any purchase you make from FitnessCA ("we", "us", "our"). You can contact us at fitnesscasupport@outlook.com.

By using this website or placing an order, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Medical Disclaimer. If you do not agree, please do not use the website or buy our products.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to make a purchase. Our programs are not designed for children.

2. Our products are digital

Everything we sell is a digital product: downloadable PDF files and spreadsheet files. No physical goods are shipped. Each product page states the format, what is included, the equipment needed, and the difficulty level.

3. Your license to use the products

When your payment is complete, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the product you bought for your own personal, non-commercial use. You may print one copy of PDF materials for your personal use.

You may not:

• resell, redistribute, share, sublicense, rent, or give away the products or any part of them;
• upload the products to file-sharing sites, social media, cloud folders shared with others, or any public location;
• share your download links with anyone else;
• use the products to train or coach clients, run group classes, or for any other commercial purpose;
• copy, modify, translate, or create derivative products from the materials for sale or distribution.

We may end your license if you break these rules. All rights not expressly granted to you are reserved by us.

4. Orders, prices, and payment

Prices are shown in US dollars and may not include applicable taxes, which are calculated at checkout. Payments are processed by our third-party payment provider; we do not store your full card details. We may refuse or cancel an order, for example if we suspect fraud or a pricing error. If we cancel an order after you have paid, we will refund you in full.

5. Delivery

After payment, we deliver your product by email with a download link. Download links expire 30 days after they are issued. If you have not received your link within 24 hours, please check your spam folder and then contact us.

6. Refunds

Because digital products are delivered immediately, sales are final except in the situations described in our Refund Policy.

7. Health and safety

Our products provide general fitness information for educational purposes only. They are not medical advice and are not a substitute for advice from a physician or other qualified healthcare provider. Consult a physician before starting any exercise program. Exercise carries an inherent risk of injury; you choose to take part voluntarily and are responsible for exercising within your own limits. 8. No guarantee of results

Individual results vary. We do not promise or guarantee any particular outcome from using our products.

9. Intellectual property

All content on this website and in our products, including text, images, graphics, and spreadsheets, is owned by us or our licensors and is protected by copyright and other intellectual property laws.

10. Disclaimer of warranties

To the fullest extent permitted by law, the website and products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow these exclusions, so they may not fully apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we and our owners, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the website or products. To the fullest extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for that product.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, or any rights you have as a consumer that cannot be waived.

12. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the products, to the extent permitted by law.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which FitnessCA is established, without regard to conflict-of-law rules. This does not take away any protection you have under the mandatory consumer laws of the country where you live.
